University of Washington law professor Xuan-Thao Nguyen discussed her new book, “Silicon Valley Bank: The Rise and Fall of a Community Bank for Tech,” with UVA Law professor Elizabeth A. Rowe. Nguyen’s book provides a first-hand account of the founding, ascent and dissolution of Silicon Valley Bank, a tech community bank founded in 1982 with $5 million that became the nation’s 13th-largest bank and the tech industry’s lender and bank.
Xuan-Thao Nguyen, a professor at the University of Â鶹ÉçÇø of Law, tells Eater Seattle that Starbucks will have to clear several hurdles to prove that Starbucks Workers United is committing trademark infringement or diluting the value of Starbucks’s trademarks. Starbucks Workers United can argue that it is using the word Starbucks in its name “to identify who they are” rather than using it as a trademark. Another issue, Nguyen says, is that Starbucks Workers United has had its name since 2021 and Starbucks is only objecting now; the union can use a defense called “laches” to argue that the company has waited too long to take legal action.
University of Â鶹ÉçÇø of Law Professor Xuan-Thao Nguyen said the lawsuit was filed within the three year statute of limitations set by the Defend Trade Secrets Act. “Trade secrets litigation is factually intensive and specific,” Nguyen said by email. “When the misappropriation claim is within its statute of limitation period, the complaint should not be dismissed at this early pleading stage.”
Xuan-Thao Nguyen, the director of the Asian Law Center at the University of Washington’s law school, told Recode that part of the solution should include considering regulations that would require crypto losses and gains to be reported at their fair value, as well as protections for crypto custodial accounts similar to those that come with stock accounts operated by brokerage firms.
